1) Who We Are

2) Eligibility

• Age requirement: You must be at least 18 years old to use the Site, create an account, place orders, enter the Shazory Pet Contest, or vote.
• Compliance: You represent that your use of the Site complies with all applicable laws and regulations.

3) Accounts and Security

• Accuracy: You agree to provide accurate, current information and keep it updated.
• Security: You are responsible for activity under your account and for maintaining password confidentiality.
• Termination: We may suspend or terminate access for violations of these Terms, suspected fraud, abuse, or security risks.

4) Policies Incorporated by Reference

These Terms incorporate the following documents, which are part of your agreement with us:

• Privacy Policy
• Shazory Pet Contest Official Rules
• Any posted Shipping or Return Policies published on the Site.

Conflict rule: If a conflict exists, the Official Rules control for the Pet Contest, and the Privacy Policy controls for data practices.

5) User Content and Your Responsibilities

The Site may allow you to upload or submit content such as photos, images, text, captions, names, and designs (User Content).

You represent and warrant that:

• You own or have all necessary rights and permissions to submit User Content.
• Your User Content does not infringe copyrights, trademarks, privacy rights, or publicity rights.
• You have permission from any person appearing in the content.
• You understand User Content submitted to public contest features may be viewable and shareable by others.

6) License You Grant to Shazory

When you submit User Content, you grant Shazory a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, display, process, and use your User Content only as reasonably necessary to:

• Operate the Site and services;
• Generate previews and print-ready files for custom products;
• Fulfill orders and provide customer support;
• Administer the Pet Contest (displaying entries, leaderboards, voting);
• Detect fraud and enforce policies;
• Comply with law and enforce our agreements.

You retain ownership of your User Content, subject to this license.

7) Intellectual Property

All Site content (excluding User Content)—including branding, designs, text, graphics, logos, and software—is owned by or licensed to Shazory and is protected by intellectual property laws. You may not copy or reuse our content without permission.

8) Products and Ordering Overview

Shazory offers products through different channels. Your rights depend on the transaction type:

• Creator Studio: Custom products purchased on getshazory.com.
• Shazory Picks: Ready-made products purchased on getshazory.com.
• Shazory on Amazon: Products purchased via Amazon.com (governed by Amazon).

9) Creator Studio Products (Custom)

• Made-to-order: These items are produced specifically for you after you order.
• Proofing: You are responsible for reviewing your inputs (spelling, cropping, image quality) before ordering.
• Final Sale: Custom items are non-returnable and non-refundable, except for verified production defects.

10) Shazory Picks Products

Shazory Picks are sold directly through getshazory.com. We handle the transaction, shipping, and returns according to our posted policies.

11) Shazory on Amazon

We sell official Shazory brand products on Amazon. If you purchase our products via Amazon.com:

• The transaction is processed by Amazon, not getshazory.com.
• Returns, refunds, and shipping are governed entirely by Amazon’s policies.
• We cannot manually override Amazon's shipping times or return decisions for these orders.

12) Shipping and Delivery (Site Orders)

• Address accuracy: You are responsible for providing a correct shipping address.
• Estimates: Shipping timelines are estimates, not guarantees.
• Risk of loss: Transfers to you upon delivery confirmation by the carrier.

13) Returns and Defect Claims (Site Orders)

Defect Claims: If you receive a defective or incorrect item ordered from getshazory.com, contact hello@getshazory.com with photos. If verified, we may provide a replacement or refund.

Not a Defect: Customer errors (typos, low-res images, wrong crop) and minor color variations due to printing processes are not considered defects.

14) Store Credit and Codes

• No cash value: Credit/codes are not redeemable for cash unless required by law.
• Non-transferable: Credit cannot be sold or assigned.
• Fraud: We may cancel credit issued due to fraud or abuse.

15) Shazory Pet Contest

We operate the Shazory Pet Contest, governed by the Official Rules. If these Terms conflict with the Rules, the Rules control for the contest.

• Free Entry: No purchase necessary.
• Public Nature: Entries are public. We cannot control third-party sharing.
• Integrity: We may remove votes or disqualify entries for fraud or manipulation.

16) Prohibited Uses

You agree you will not:

• Use the Site for unlawful purposes.
• Submit infringing, abusive, or deceptive content.
• Use bots or automated systems to vote, scrape, or manipulate the Site.
• Impersonate another person or misrepresent eligibility.

17) Disclaimers and Limitation of Liability

"As-Is" Service: The Site is provided on an "as-is" basis without warranties of any kind.

Liability Cap: To the maximum extent permitted by law, Shazory will not be liable for indirect, incidental, or consequential damages. Shazory’s total liability for any claim will not exceed the amount you paid to Shazory in the 30 days before the event giving rise to the claim.

18) Disputes, Arbitration, and Class Action Waiver

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania.

Binding Arbitration

Any dispute arising from these Terms or your use of the Site shall be resolved by binding arbitration in Pennsylvania, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver

You and Shazory agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Jury Waiver

If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.

19) Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes means you accept the updated Terms.
