Order of Precedence: If there is a conflict between policies:
• The Official Rules control for contest issues.
• The Refund Policy controls for returns and refunds.
• The Shipping Policy controls for delivery and transit issues.
• The Privacy Policy controls for data handling.
• These Terms control for all other matters.

1) Eligibility and Accounts

• Age requirement: You must be at least 18 years old to use the Site, place orders, enter contests, or vote.
• Account accuracy: You agree to provide accurate and current information.
• Account security: You are responsible for all activity under your account.
• Right to refuse service: We may suspend or terminate access for fraud, abuse, or violations.

2) User Content and Permissions

You may upload photos, text, captions, or designs (“User Content”) for custom products or contests. You represent that you own or have all necessary rights to submit such content.

You acknowledge that you will not receive any compensation for User Content used to operate the Site or contests as described.

3) Orders and Products

Creator Studio (Custom Products)

• Custom products are made-to-order.
• Custom products are generally final sale except for verified defects.
• You are responsible for reviewing designs, spelling, images, and selections before checkout.

Marketplace Products

Ready-made products may be eligible for returns as defined in our Refund Policy. Fulfillment methods may vary by product and destination.

Taxes

We may collect taxes where required. International orders may be subject to duties, VAT, or customs fees, which are the customer’s responsibility unless the Site explicitly states otherwise.

4) Shipping and Risk of Loss

• Shipping timelines are estimates only.
• Risk of loss transfers to you upon carrier delivery confirmation, unless otherwise required by applicable law.
• You are responsible for address accuracy.

5) Payments and Chargebacks

You agree to provide current, complete, and accurate purchase and account information for all purchases made through the Site.

• Disputes: If you have an issue with an order, you agree to contact Shazory support first to resolve it.
• Chargebacks: Chargeback abuse or dishonest claims (e.g., claiming item not received for a delivered item) may result in account restriction or permanent ban, and we may submit documentation to the bank to contest the dispute.

6) Store Credit and Promotions

• Store credit has no cash value.
• Credits are non-transferable.
• Credits may be revoked if issued due to fraud or abuse.
• Store credit is subject to applicable law, and any legally required terms will apply.

7) Contests (Shazory Pet Contest)

Shazory operates the Shazory Pet Contest, governed by separate Official Rules.

• Votes may be adjusted or removed for fraud or manipulation.
• Disqualification and prize withholding may occur.
• Finality: All decisions regarding the Contest, including voting validity, eligibility, and winner verification, are final and binding. Winners may be announced only after the completion of the integrity review process.
• Right to Modify: Shazory may modify, suspend, or terminate the contest (or any entry/voting functionality) at any time for integrity, security, legal, or operational reasons, with or without notice, subject to the Official Rules.

8) Third-Party & Amazon Orders

Amazon Purchases: Products purchased through Shazory's Amazon store are subject to Amazon's policies for shipping, returns, and refunds.

Third-Party Services and Links: The Site may rely on third-party platforms and providers (including payment processors, print and fulfillment partners, and shipping carriers). We are not responsible for third-party systems outside our reasonable control. The Site may also contain links to third-party websites. We do not control and are not responsible for third-party content or practices.

9) Prohibited Uses

• Illegal, harmful, or abusive conduct
• Vote manipulation, bots, scripts, or automation
• Creating multiple accounts or engaging in coordinated behavior to manipulate voting or outcomes
• Scraping, harvesting, or extracting data from the Site (including entries, images, emails, vote totals, or leaderboards) without permission
• Security bypass attempts or accessing non-public areas
• Impersonation, misrepresentation, or false claims (including rights to upload content)
• Submitting content that infringes intellectual property rights or violates privacy/publicity rights

10) Copyright & DMCA Policy

Shazory respects intellectual property rights. If you believe your copyrighted work has been infringed by content on our Site, please submit a written DMCA notice to hello@getshazory.com (Attn: DMCA).

A valid DMCA notice should include:

• Your name and contact information (address, phone, and email)
• Identification of the copyrighted work you claim has been infringed
• The specific URL or location on the Site where the material appears
• A statement that you have a good-faith belief the use is not authorized
• A statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act on behalf of the owner
• Your physical or electronic signature

If appropriate, we may remove or disable access to the content and may notify the user who posted it. We also accept valid counter-notices where applicable. We terminate repeat infringers in appropriate circumstances.

11) Disclaimer of Warranties

The Site, products, and services are provided as-is and as-available. We do not guarantee uninterrupted service, specific outcomes, or accurate results.

TO THE FULLEST EXTENT PERMITTED BY LAW, SHAZORY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12) Limitation of Liability

To the maximum extent permitted by law, Shazory will not be liable for indirect, incidental, special, or consequential damages.

Total liability will not exceed the greater of: (A) the amount you paid to Shazory through the Site in the 30 days preceding the event giving rise to the claim; or (B) $100 USD.

13) Binding Arbitration & Class Action Waiver

Arbitration provider and rules: Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or other applicable AAA rules), as modified by these Terms.

Location and format: Unless the parties agree otherwise, arbitration will take place in Pennsylvania. The arbitrator may allow proceedings to be conducted by telephone, video, or based on written submissions where appropriate.

Fees: Payment of filing, administration, and arbitrator fees will be governed by the AAA rules and applicable law. The arbitrator may award fees and costs to the extent permitted by law.

How to start arbitration: Before initiating arbitration, you agree to send a written Notice of Dispute to hello@getshazory.com describing the issue and the relief you seek. If the dispute is not resolved within 30 days after the Notice is received, either party may initiate arbitration.

Class Action Waiver: You and Shazory agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14) Indemnification

You agree to indemnify Shazory against claims arising from your content, actions, or violations of these Terms.

15) Termination

We may suspend or terminate your access to the Site and any related services at any time if we believe you violated these Terms, engaged in fraud or abuse, or created risk to Shazory, other users, or third parties.

Termination does not limit our right to pursue other remedies. Sections that by their nature should survive termination (including User Content permissions, disclaimers, limitation of liability, arbitration, indemnification, and general provisions) will survive.

16) General Provisions

• Electronic Communications: By using the Site, you consent to receive communications from us electronically. You agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that such communications be in writing.
• Entire Agreement: These Terms and the policies incorporated by reference constitute the entire agreement between you and Shazory regarding the Site and supersede prior agreements or understandings on the same subject.
• Assignment: Shazory may assign these Terms or its rights at any time without notice. You may not assign these Terms without our written consent.
• Changes to Terms: We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance.
• Severability: If any provision is unenforceable, the remaining provisions remain in full effect.
• Headings: Section headings are for convenience only.

17) Governing Law and Limited Court Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law rules.

Venue carve-out: If a dispute is eligible for small claims court, you may bring it in the appropriate small claims court. In addition, either party may bring an action in a Pennsylvania state or federal court to compel arbitration, stay proceedings pending arbitration, or to enforce, confirm, modify, or vacate an arbitration award, or to seek injunctive relief where permitted by law.
